EWING TOWNSHIP: Two Senate Bills Propose Changes For Foreclosures And Delinquent Property Tax Notices And Payments

Ewing Township issued the following announcement on March 4.

Two Senate bills propose changes for foreclosures and delinquent property tax notices and payments. Senate Bill 725, sponsored by Senator Jim Runestad (R-White Lake Chtr. Twp.), would require additional provisions to be included to property owners to avoid foreclosure and sale of property. Under the bill, the notice would include a statement that warns the property owner that a payment submitted to the local tax-collecting unit instead of the county treasurer may not prevent foreclosure or be applied to the delinquent bill. The notices would also include a statement that payment plans may be available to avoid a foreclosure or sale in counties offering payment plans; a schedule including additional interest, fees and penalties that may accrue; and contact information for help preventing foreclosure.

Under SB 726, sponsored by Senator Ruth Johnson (R-Holly Twp.), a foreclosure can be cancelled by a certificate of error if a payment was made on taxes levied after the levy of taxes relating to the foreclosure and if the amount paid was greater or equal to the amount necessary to avoid the foreclosure. A person with an interest in the property would need to notify the foreclosure governmental unit of the payment error and complete a form prescribed by the state Department of Treasury.
