1. Mayor Arview Called The Meeting To Order At 6:00 P.M. Requesting A Roll Call. All Commissioners Were In Attendance Including, The City Attorney And City Clerk.
2. Mayor Arview Asked For Approval Of The Agenda. The Mayor Stated We Do Have One Item To Amend. Item Number Three, We Have An Additional Property To Advertise: 202 North Douglas Street. I Entertain A Motion To Amend The Agenda. Commissioner Warren Made A Motion To Approve, Seconded By Commissioner Stanley. Roll Call Vote: All Commissioners And Mayor Arview Voted To Approve. Motion Carried.
3. Mayor Arview Asked For Approval Of The Agenda As Amended. Commissioner Harkins Made A Motion To Approve, Seconded By Commissioner Warren. Roll Call Vote: All Commissioners And Mayor Arview Voted To Approve. Motion Carried.
4. The Next Item Was Approval Of The Minutes From The April 8, 2025 Regular City Council Meeting. The Mayor Stated I Entertain A Motion For Approval. 5. The Next Item Was Approval To Advertise For Demolition Bids For 1309 East Oak, 1216 East Oak, And 202 North Douglas. Commissioner Stanley Made A Motion To Approve, Seconded By Commissioner Howard. Roll Call Vote: All Commissioners And Mayor Arview Voted To Approve. Motion Carried.
6. The Next Item Was Approval Of A Proclamation Declaring May 8, 2025 Through May 11, 2025 As The West Frankfort Old King Coal Festival. The Mayor Read The Proclamation.
Whereas The Old King Coal Festival Is A Celebration Of Community Spirit And Tradition For West Frankfort; And
Whereas The Festival's Events, Parade And Pageantry Showcase The Abilities Of Our Young People And Community Groups And Encourage Investment In The Local Economy; And
Whereas The Festival Would Not Be Possible Without The Support Of Numerous Sponsors, The Cooperation Of Event Organizers, The Contributions Of Hundreds Of Hours By Many Volunteers, And The Participation Of The Community; And
Whereas The 84th Anniversary Of The Old King Coal Festival, Which Started In 1941, Inspires Us To Realize The Role That Coal Plays In Our Lives As West Frankfort Residents;
Now, Therefore, I, Tim Arview, Mayor Of West Frankfort, Do Hereby Proclaim May 8- May 11, 2025 As The West Frankfort Old King Coal Festival In The Municipality Of West Frankfort, And Encourage Everyone To Participate In Many Of The Great Events That This Community Festival Has To Offer.

7. The Next Item Was Approval For The Family Of Janet Dutton To Hold Road Block Fundraiser On May 2,2025 From 9:00 A.M. - 4:00 P.M. And May 3, 2025 From 9:00 A.M. - 4:00 P.M. At The Intersection Of Route 149 And Highway 37. Commissioner Stanley Made A Motion To Approve, Seconded By Commissioner Warren. Roll Call Vote: All Commissioners And Mayor Arview Voted To Approve. Motion Carried.
8. The Next Item Was Discussion, With Possible Action, Regarding The Application For A Liquor License For Celina's. The Mayor Stated We Are Going To Table This Item; We Had A Meeting With The Planning Commission Last Night And The Applicants Were Not Able To Attend That Meeting. They Reached Out To Me Today And The Reason They Couldn't Attend Was A Family Emergency. They Asked If We Could Reconsider That At A Later Time. We Will Push This Back Until They Have A Chance To Present To The Planning Commission. This Item Was Tabled.
9. The Next Item Was Discussion, With Possible Action, Regarding Approval Of An Ordinance Regarding Livestock Within The West Frankfort City Limits. The Mayor Stated I Did Put Out A Survey On The Website. It Didn't Get A Lot Of Response, Their Was A Total Of One Hundred And Ten Responses. Out Of Our Population That Is Less Than One - Percent. Of Those Who Did Was In Favor Of Changing The Live Stock Ordinance To Allow Owning Chickens Within City Limits. I Will Open The Floor For The Council. I Will Ask Not From The Audience, We Do Have A Section For Public Comments. The Issue Is If We Open This Up For Public Comments Then We Have To Open Every Thing Up, And The Meetings Will End Up Taking All Night. That Is Why There Is One Section For Public Comments. I Know There Are People Here In Support Of It. I Also Know There Are People Who Are Opposed To It. Commissioner Stanley Stated My Opinion Is, It Is Going To Give More Work For The City, Codes, And Clerk. They Have Enough Going On Without Extra On Their Plates. I Am Not For It. Commissioner Warren Stated The Ordinance Has Several Rules That You Have To Go By To Have A Chicken Coop. You Have To Go By The Guidelines On The Gauge On The Chicken Wire, Coop To Run, Shade, The Property Line Is Within One Hundred Feet Of The Proposed Chicken Coop Location. There Is More In The Ordinance. The Chief Of Police And The Codes Officer Would Have To Be In Charge Of Chasing Chickens Down If They Got Loose. I Don't Think They Will Have Time For That. Commissioner Howard Stated I Am Also Concerned About Health Issues. Histoplasmosis Is One Of The Things That Is A Problem With Chicken Manure. Commissioner Warren Stated The Codes Officer Would Have To Check The Coop Before You Can Do Anything, They Can Not Be Free Range, And You Will Have To Get Along With Your Neighbors. The Mayor Stated You Will Have To Have Approval From Your Neighbors To Be Able To Do It. Commissioner Harkins Stated I Think Up To Now We Have Done Good Without It. Commissioner Warren Stated I Think We Have Enough Going On Right Now Without Having To Worry About This. The Mayor Stated The Way This Was Worded We Do Not Need To Make A Motion. It Is Discussion With Possible Action. Commissioner Warren Stated I Don't Think With How Close The Houses Are And The Stipulations That You Have To Be So Far From Your Neighbors Will Be Hard To Do In Town. The Mayor Stated Maybe At Some Point In The Future We Can Reconsider It.

The Next Item Was Discussion, With Possible Action, Regarding Approval Of An Ordinance Amending Section 5.04.210 Of The West Frankfort Code Of Ordinances Entitled "Alcoholic Liquor" To Clarify Language Regarding Hours Of Operation For All License Holders. The Mayor Stated Our Existing Ordinance For Hours And Operations Are Hard To Discipher. In One Place It Says That No One With A Liquor License Can Be Opened On Sunday After 2:00 A.M. Until 5:00 A.M. The Following Monday, But Then Later In The Same Ordinance It Says They Can Be Opened From 11 To 11. It Kind Of Conflicts. There Was Some Other Language That Seemed Muddy. It Seems Like It Had Been Amended A Few Times Before And The Old Language Was Never Removed Or Changed. I Wanted To Present Something That Gave A Clear Line On What We Are Actually Talking About. I Did Make A Change Through Recommendation From Commissioner Stanley, And Also Got Some Feedback Online Regarding This. That The Class A, B, B1, And C Will Be Able To Only Sell Alcohol On Sunday From 11:00 A.M. Until 10:00 P.M. Monday Through Thursday From 5:00 A.M. Until Midnight, And Friday 5:00 A.M. Until Saturday At 2:00 A.M. Two Hours Past Midnight And Can't Sell Any Saturday Between The Hours Of 2:00 A.M. And 5:00 A.M. Then Open Again Until Sunday At 2:00 A.M. Which Is Two Hours Past Midnight Saturday. That Will Be For The Class A & C. The Class B None Of The Rest Of Them Changed Except For The Sunday. Monday Through Saturday 5:00 A.M. Until Midnight. Class D, D1, And D2 Which Are The Restaurants They Are 11:00 A.M. Until Midnight On Sundays, And 5:00 A.M. To Midnight Monday Through Saturday. At Some Point We May Need To Revise The Class Of Licenses. The Difference Between A Bar And A Restaurant Are Kind Of Blurry These Days. A Lot Of Bars Sell Food. By Having This Language Clearer Will Help The Law Enforcement To Know The Hours They Need To Enforce. Commissioner Warren Made A Motion To Approve, Seconded By Commissioner Stanley. 11. The Next Item Was Approval Of An Ordinance To Set Date For A Public Hearing For The City Of West Frankfort Tax Increment Financing Redevelopment Plan And Project. The Mayor Stated The Hearing Will Be Held On Tuesday June 10, 2025 At 5:30 P.M. Before Our Meeting On That Day. It Will Be A Public Hearing For The Public To Come Out And Ask Questions About The T.I.F. And Make Any Comments They Want To Make To Our Economic Developers And To Us. Commissioner Warren Made A Motion To Approve, Seconded By Commissioner Stanley. Roll Call Vote: All Commissioners And Mayor Arview Voted To Approve. Motion Carried.
12. The Next Item Was Discussion, With Possible Action, Regarding An Amendment To The Water Utility Ordinance To Clarify Responsibilities And Other Language. The Mayor Stated This Was Brought To Me By Our Water Superintendent That Some Of The Language Was Out Dated, The Process Has Changed, And Requirements Has Changed. This Is Reflecting Those Changes Requested By Him. Commissioner Warren Asked What Is The Sentence That Says All Previously Required Documentation Concerning Ownership, Tax Records, Or Credit Rating Is No Longer Necessary For Water Service Activation. The Mayor Stated The Existing Ordinance Required That They Had To Have A Tax Bill. The Water Superintendent Mr. White Stated This Is To Change The Things We Do Not Accept, They Have To Have Something That Shows They Own The Property Itself. The Mayor Stated Like A Deed, Contract For Deed, Or Lease Agreement. Commissioner Stanley Made A Motion To Approve, Seconded By Commissioner Warren. Roll Call Vote: All Commissioners And Mayor Arview Voted To Approve. Motion Carried.
13. The Next Item Was Approval Of Ordinance To Amend Chapter 5.56 Of The West Frankfort City Code Pertaining To Peddler's Permits. The Mayor Stated We Do Not Want To Discourage Food Trucks, Itenant Merchants, Those Kind Of Things. I Am All For Free Enterprise. But When It Starts To Affect The Pocket Book Of People Who Have Invested In Our Community To Open A Brick And Mortor Restaurant That Is When It Can Become A Problem. We Have Worked Out This Amendment To Incentive People To Open Up Shop Instead Of Doing A Food Truck. The Codes Officer Looked At Other Cities And Modeled This After Them On What They Require. The Fee Was A Per Day Fee, But We Changed It To A Monthly Or A Yearly Fee To Pay. The Codes Officer Stated We Require Other Businesses In Town To Register As Businesses. The Mayor Stated If I Had An Idea For A Restaurant, Maybe I Wouldn't Want To Invest Into A Building. But If It Seems Like It Is Going To Work, Then It Is Time To Start To Look At A Building. Commissioner Warren Stated A Lot Of These People Enjoy Moving Around, And They Make Good Money Doing It. Does That Bring Money Into Town When They Register? The Mayor Stated To An Extent. It Is Really About Paying For The Codes Officer To Be Able To Enforce Requirements. Commissioner Warren Stated It Is Fair For The Brick And Mortar People. I Like The Food Trucks That Come Into Town, We Want Them To Keep Doing It. Commissioner Howard Stated They Are Supposed To Be Paying Sales Tax In Every Town They Are In. Whether They Are Doing That I Do Not Know. The Codes Officer Stated This Gives Us The Opportunity To Check. The Mayor Stated We Have Found Out What We Are Charging Is Not As Near As Other Cities Around Us Are Charging. Commissioner Howard Made A Motion To Approve, Seconded By Commissioner Stanley. 14. The Next Item Was Approval To Pay Invoice From Novacom In The Amount Of $13,500.00 For Annual I.T. Labor For The West Frankfort Police Department. The Mayor Stated Because Of The Amount Of This, Normally It Would Be Presented In The Bills. We Felt Like We Would Need To Talk About This Separately. Deputy Chief Willis Stated They Come To Our Department Twice A Week. Regularly Twenty-Four Hours A Day We Have Them By Phone. This Is Incase We Have Any Issues Or Update Of The System They Come Here. They Come And Regularly Check And Make Sure Everything Is Running Smooth. It Is A Yearly Service To Be Our Dedicated Personnel Company, Instead Of Paying Them Evereytime They Come Out. 15. The Next Item Was Approval To Pay An Invoice From Executive Outsourcing In The Amount Of $12,638.02 For The City Of West Frankfort Audit Prep. The Mayor Stated This Is The First One And Part Of Another We Have Received. This Includes The Travel From Chicago, That Will Make It A Little Bit Higher Than The Future Ones May Be. This Is The Person We Brought In To Help Us Get The Books Straightened Out For Audit Purposes. I Recommend We Do Pay This, And Keep Her Until We Can Get It Done. 16. The Next Item Was Approval To Accept Proposals Received From Illini Asphalt And Beelmen Logistics For The 2025 MFT Program. Mr. Roberts, A Representative From Brown & Roberts, LLC Stated We Have Received Bids For Proposals For Different Groups. Illini Was The Sole Bidder On Three Of Them And Beelmen Was The Sole Bidder On The Other. Commissioner Stanley Made A Motion To Approve, Seconded By Commissioner Warren. Roll Call Vote: All Commissioners And Mayor Arview Voted To Approve. Motion Carried.
17. The Next Item Was Approval Of A Resolution To Accept MFT Prices For The 2025 MFT Bid Opening. Commissioner Warren Stated This Is Motor Fuel Tax Money For Resurfacing And Fixing Roads For Materials For Projects. Commissioner Stanley Made A Motion To Approve, Seconded By Commissioner Howard. Mayor Arview Stated We Have Old King Coal Coming Up, I Encourage People To Come Out And Have A Good Time. The Festival Is May 8th Through May 11th.

Commissioner Harkins Stated The Police And Fire
Department Are Doing Good, And Staying Busy. All Of Our Equipment Is Working Right Now. When Do We Get Our New Truck Back On The Highway? Fire Chief Saillez Stated Probably In A Week And A Half. Commissioner Harkins Stated With The Old King Coal Coming Up, There Is Always A Problem Transporting The Seniors Citizens That Can Not Park Where They Usually Park. I Do Not Know If They Have Discussed That With You Or Not. The Mayor Stated Yes, They Have Brought It Up, We Do Have Some Concerns. We May Put Something On The Agenda. I Will Talk To You Guys Individually About That. There Was Some Concerns About Liability If We Were Going To Transport Them. Commissioner Stanley Asked How Many Of The Squad Cars Can You Move Back There? Deputy Chief Of Police Willis Stated I Am Going To Be Moving All Of Them. Commissioner Stanley Stated That Will Give Us Room For The Senior Citizens To Park There. Deputy Chief Of Police Willis Stated That Is Where They Park The Campers, And It Will Give Some Room For Other Parking. Commissioner Stanley Stated Maybe We Can Block Off An Area Before The Campers Get Here For The Senior Parking.
Commissioner Howard Stated I Am Happy To Report There Is Real Progress Being Made On Getting Our Accounting Records Straightened Out. I Have Been In Public Accounting For Over Fifty Years And This Maybe The Biggest Mess I Have Ever Seen. This Lady Who Is Helping Us Is Getting Us Straightened Out. She Is Working All Of The Time. I Am Hoping We Get Both 2023 And 2024 Straightened Out In A Short Period Of Time. That Way We Can Get Both Of Our Audits Done.
Commissioner Stanley Stated Sewer And Water Guys Are Doing Good. Street Guys Did A Good Job On Emma And Oak. All Of The Departments Are Keeping Busy.
Commissioner Warren Stated We Had To Do A Temporary Repair To The Incubator's Roof, Because Of All Of The Wind And The Rain. We Are Looking Into The Cost To Fixing The Roof. We Sold Approximately One Hundred And Eighty Lake Stickers. On April 26th, 2025 The Fin And The Feather Club
Will Be Having A Fishing Tournament, I Am Not Sure Which One. They Did Come In And Get A Permit. We Had A Lake Board Meeting; We Will Be Working On Some Good Ideas For Projects Once The Audit Gets Done. I Will Let Thad Give You An Update On The Meeting. Mr. Snell Stated The Idea Is To Start Utilizing The Lake A Little More Properly. I Know People Seen The New Fence And Thought We Were Shutting It Down. The Point Of That Is To Give Us An Opportunity To Regulate It, And To Use It Properly. The Idea From This Point Forward Is To Give People The Opportunity To Hunt Out There Legally. We Talked About How To Do That Properly. We Also Talked About Creating Hiking Trails Out There, More Of A Natural Type Trail. That Way We Don't Have To Maintain And Spend The Money. We Talked About Adding More Access Points From The Number Nine Blacktop. There Are Still A Lot Of Moving Parts To Everything We Are Working Towards.

Jeff Clark Stated I Have A Question Concerning The Livestock Ordinance. Right Now, What Is The Penalty For Violating That Ordinance? I Know There Is A Gentleman On McClelland Street That Has A Goat, I Was Notified That Someone In Town That Has A Horse And A Cow, And At Least Three Dozen People That Has Chickens Now. I Am Not Trying To Get Anyone In Trouble. I Just Would Like To Have Chickens For My Kids. I Am Not Sure If There Is A One Time Penalty, Or If It Is A Daily Penalty. Codes Officer; Mr. Snell Stated The Penalty For Any Violation Of Our Ordinance General Violations Are $100.00 And That Is Every Day The Violation Occurs. I Have Talked To My Neighbors And They Are All Fine With It. Is This Something That Somebody Is Going To Be Coming Around Looking For? Or Is It Going To Be Based On Complaints By Neighbors? The Mayor Stated It Is Not That We Are Wanting To Excuse Any Behavior Or Anything Like That, But Obviously We Only Have One Codes Officer And A Pretty Big Town. Mr. Clark Stated I Was Looking At A Property On McClelland Street And There Is A Huge Lot Fenced With A Goat. You Can Not Tell Me That Not One Commissioner, The Mayor Or The Codes Officer Have Went Down That Road And Have Not Seen That Goat. Mr. Snell Stated I Was Not Aware Of It, But I Am Now. I Was Also Someone Said There Is A Limit On Three Animals Per House, Is That True? Mr. Snell Stated Three Dogs Or Cats. Mr. Clark Stated I Heard Everyone’s Concerns, I Get That. I Have Seen The Concerns On Social Media. The Average Concern On Social Media Was They Are Going To Be Out Running Around Like Cats And Dogs. That Is Not Even A Thing, They Will Be In Coops. I Feel Like Everyone’s Decisions Were Made Up. I Had To Force Everyone’s Hand To Even Get This On The Agenda. I Feel Like That Is A Disservice To The Ones That Showed Their Support. You Guys Have A Survey Out About Your Bike Path, And That It Was Listed For Six Months. You Had One Hundred And Sixty Respondents With A Lot Less Support. The Mayor Stated We Are Not Doing That; It Is Greater Egypt. I Recommend You Have People Come To A Meeting Before We Have To Vote On It, So They Can Address The Council. Having People Come To The Meeting Where We Are Going To Have The Vote, Would Not Do Much Good. Because We Would Already Have To Vote. That Is Why I Wanted You To Do It That Way. If There Is Enough People That Wants To Do Something, Then I Am All For It. We Will Figure Out A Way To Do It. Mr. Clark Asked Can I Have A Petition Signed, Would That Count? Not Everyone Is Able To Join The Meetings. The Mayor Stated I Know There Are Some People That Can Not Come To The Meetings. That Is Why I Do It Live. We Just Need To Know Enough People Want It, That Makes It Worth It. I Think It Is Nieve To Think People Are Not Going To Have Their Chickens Run Around, Because We Have Rules About Dogs And Cats Too But People Violate Those. I Think It Is A Good Thing To Think No One Will Break The Law, But There Are People Who Do. I Can See If We Pass This Ordinance Someone Will Think They Can Have Chickens Without Reading The Ordinance To Follow It. Also With Your Concern On How There Are Already A Lot Of People Who Are Breaking This Ordinance Is Noted. I Had Said If We Passed It We Would Have To Do Some Work To Make Sure We Enforce It. Janet Nicholas Stated Three Years Ago, I Had Chickens And No One Said You Couldn't Have Them. My Coop Was In Sight Where Anyone Could See Them. It Was An Awesome Experience. I Came From The County Originally. I Think It Is A Great Thing To Do, And I Enjoyed It. I Wish And Hope We Can Get More People Up Here That Are Interested.
